KeepTree™ Privacy Policy

Updated as of October 2013

The KeepTree, Inc. Privacy Policy describes how KeepTree, Inc. and its subsidiaries treat personal information when you use KeepTree services, including information provided when you use or any KeepTree mobile application (collectively, “KeepTree”).

Personal Information

Protection of Your Information – KeepTree takes precautions to protect your information. We have partnered with Blue Ridge Networks, a recognized cyber security market leader whose technology also protects servers of both government and financial institutions, to create the most advanced security features in the video messaging industry in order to protect both your personal information and videos. When you submit sensitive information on KeepTree, your information is protected both online and offline. Whenever we collect credit card data, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees or other authorized third party representatives who need the information to perform a specific job, such as billing or customer service, are granted access to personally identifiable information.

Browsing – You may not record or view private videos on KeepTree without having a KeepTree account, but you may browse some aspects of the service and view public videos sent to the US Military on the “Thank You Vault” without a KeepTree account. You may also contact us through channels provided on KeepTree or by emailing us directly without having to register for an account.

Your Account – For some activities on KeepTree, like recording videos, posting comments, “watering” videos, flagging videos to report abuse, or watching private videos, you need a KeepTree account. We ask for some personal information when you create an account, including your email address, your name (although you are free to provide a pseudonym), and a password, which is used to protect your account from unauthorized access. A KeepTree Account, additionally, allows you to access other services that require registration.

Usage Information – When you use KeepTree, we may record information about your usage of the site. If you are logged in, we may associate that information with your KeepTree Account. In order to ensure the quality of our service to you, we may place a tag (also called a "web beacon") in HTML-based customer support emails or other communications with you in order to confirm delivery.

Content Recorded on the Site. Any personal information or video content that you voluntarily disclose online (e.g., video comments, your profile page) may be collected and used by others. The privacy level of such content and information may be controlled by you in the user settings of your KeepTree Account, and will not be accessible except by your permission under your user settings and as disclosed in other sections of this Privacy Policy.

Administrative Use – If you submit personal information to KeepTree, we may use that information to operate, maintain, and improve the features and functionality of KeepTree, and to process any flagging activity or other communication you send to us.

Email Communication – We do not use your email address or other personal information to send commercial or marketing messages without your consent. By signing up for KeepTree, you give us initial consent to contact you with such messages. You may revoke such consent at any time by clicking the “unsubscribe” button at the bottom of any commercial or marketing emails. We may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major KeepTree changes, for customer service purposes, and to notify you that you have received a video). You also can choose how often KeepTree sends you email notifications in your KeepTree Account user settings page.

Cookies/Web Beacons/Log File Information – We use cookies, web beacons, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

Transactional Information – We may share some sensitive information, such as your name and credit card data, with authorized representatives of third party credit card processing companies, only to the extent necessary for such third parties to process any transactions you make with us. Any transmission of such sensitive information is encrypted and transmitted in a secure way.

Content – KeepTree will never share your content publicly except for content that you choose voluntarily to make public. We may view your content internally in order to evaluate and respond appropriately to flagging or reports of abuse, but such viewings will be limited to the extent necessary to make such evaluations. We may also present your content in strict confidentiality with potential investors and partners. In such situations we will take steps to protect your privacy by withholding identifiable personal information and/or making agreements of confidentiality and/or non-disclosure of information with such third parties.

Other Uses – We may also release some of your personal information only to the extent necessary to prevent illegality, comply with applicable laws and government agency requests (and even then we will release only information that is mandatory), and to prevent public or personal harm

Information Sharing Within KeepTree

Publicly Available Information – When you create a KeepTree Account, some information about your KeepTree Account and may be viewable by other users of KeepTree. This may include the name (or pseudonym) you provide for your username when you open your KeepTree account.

Information Available to Your Contacts – Other information may not be publicly available but available to those you accept as contacts, such as your age, gender, date of birth, profile picture, and other information you provide in your user profile, as well as some of your account activity (ie. whether you watched a video your contact sent to you). The sharing of such information may be controlled by you by changing your profile information.

Commenting and Video Sharing- Any videos that you record to KeepTree may be viewed by those KeepTree users who you choose to share them with. Although those videos may not be downloaded nor forwarded to another user, the recipient may still have the ability to allow others to view such videos by allowing others access to the device by which they access KeepTree (ie. letting another person look at their KeepTree app on their phone).

When you choose to share a video you are voluntarily sharing that video with the users that you select. Unlike your profile information, which will be viewable by any users that you allow as a contact, you will have the option to choose specific individual users and user groups that you may allow access to each individual video. When you choose to comment on a video sent to you, or reply to a group video sent to you, you are voluntarily sharing that video and/or comment with all users with access to the original video. Some of these users may not be contacts. Those users may view that individual video or comment, but will have no other access to any other information. Other users can also contact you by leaving a comment on the site.

Non-Contacts and Blocking Users – A video may be sent to you from somebody who is not your “contact,” but you will not be able to view it until you accept their contact request, which will be sent simultaneously with the video. You will have the ability to block certain users if you do not wish to receive videos from them.

Email Address – Your KeepTree Account name, not your email address, is displayed to other users searching for contacts on KeepTree. However, if another user has your email address, they may find you to make a contact request by searching using your email address.

Your Choices

If you have a Account, you may update or correct your personal profile information, email preferences and privacy settings at any time by visiting your account profile page.

You may control the information that is available to other users (ie. your name) and your confirmed contacts at any time by editing your KeepTree Account profile and/or user settings.

You may, of course, decline to submit personal information through KeepTree, in which case you can still view certain publicly available videos and explore KeepTree, but KeepTree may not be able to provide certain services to you, such as viewing private videos or recording videos. Some advanced KeepTree features may use third party services. The privacy notices of those services govern the use of your personal information associated with them.

More Information

Privacy is one of the most important features of the KeepTree service, and we take the privacy of both your videos and personal information very seriously. Although KeepTree will use its best efforts to maintain a high level of security for all personal information and private content, even the best security features are susceptible to unauthorized access by a third party, and you acknowledge and assume such risk when sharing your personal information and content.
